The way in which the NGO regulator applies the laws and regulations relevant to NGOs will have a fundamental impact on effective regulation. An effective regulator minimises the risk of instances of misuse of NGOs without hampering the valuable and legitimate work of the majority of NGOs.
NGO regulators need to be well-regarded by other government departments and the NGO sector, with a vision for enabling, proportionate oversight of the sector and a sustainable business plan. An effective regulator will be fair and consistent in its application of the law and will offer advice and guidance to the sector to help them comply with the law.
It will have the ability - and powers - to register NGOs; to collect and use information on NGOs; to investigate concerns about NGOs; and to take protective action where necessary. The actions of an effective regulator will safeguard the assets of individual NGOs and the reputation of the NGO sector as a whole, protecting those individuals and communities that NGOs serve.
